Non-punitive remedies

The fines and civil pecuniary penalties that can be imposed for a contravention of the Australian Consumer Law are intended to punish the contravention. In addition to these punitive measures, there are a wide range of remedies available that are not aimed at punishing the person responsible for the contravention, but which are intended to rectify the problems caused by the contravention.

These non-punitive orders include: directing the performance of a service for the benefit of the community; the establishment of a compliance program, education or training program, to ensure no further breaches; the disclosure to particular persons of information specified by the court; and the publication of an advertisement in specified terms.
