(c) That's not right. The citation of this case shows that it is reported in the Victorian Law Reports. This means that it is a decision of a superior court in the Victorian court hierarchy. Although this is an Australian court, it is not a court in the NSW court hierarchy so it will not be considered a binding precedent on any NSW court, even an inferior court such as the NSW Local Court.

However, because of the close links between the various Australian states and territories, cases decided by the courts in other Australian hierarchies are often treated as persuasive if they appear to lay down an appropriate rule. This is desirable in that it gives a degree of consistency to the law applied in the different states and territories.

It is therefore appropriate to conclude that this case is potentially of persuasive effect on a NSW Local Court, but not binding.
